FACTORY bosses are celebrating once again after a legal challenge to their plant was rejected by the courts.
The Quinn Glass plant at Elton, which employs more than 700 workers, has enjoyed its second legal victory in a matter of months against arch rival Ardagh Glass Limited.
In the latest phase of a six-year battle, the Administrative Court has refused permission to allow Ardagh to launch another judicial review against Quinn.
The application for a judicial review of the granting of planning permission by Cheshire West and Chester Council (CWaC) and Chester City Council for the plant was delayed pending the outcome of a separate application to the Supreme Court.
The Supreme Court ruled against that Ardagh application a few weeks ago.
Chief executive of Quinn Glass, Adrian Curry, said: “Quinn Glass is delighted with the news which comes in the wake of similar recent decisions by the Court of Appeal and the Supreme Court. We have developed a world class facility in Cheshire and this decision further secures the jobs of 721 people employed at the plant and allows us to concentrate on future development.”
The announcement follows an earlier court decision on February 3 this year when the Court of Appeal dismissed a claim by Ardagh Glass that CWaC had no power to grant retrospective planning permission.
The Court of Appeal found the legal position was so clear it was not necessary to hear from either the council or Quinn.
